Why do I need a Will ?­
If you do not have a Will or the Will you have is not valid then you are classed as INTESTATE

In essence if you die without a will, the law says who gets what.

The rules of intestacy specify a rigid order of who should benefit from the

estate of an intestate person.

This order is as follows

  • Spouse or civil partner receive the first £322,000 and 50% of the balance
     
  • The other 50% is shared equally between the children or their descendants

           If a son or daughter has already died, their children (the grandchildren of the deceased) inherit in their place
 

Your estate could be distributed to children or grandchildren you would not have chosen
 

If you have children the courts may decide who is appointed as the guardians

If you are not married your partner may not get anything
